Dear Sir,
We are constrained to bring to your kind notice the following fact of irrational treatment causing hypertensive reaction to a retired employee.
Sri Prokash Kumar Basu while receiving the order of his promotion to BCR Grade IV with effect from 01-07-1998 vide Chief General Manager, West Bengal Telecom Circle Memo No. EST/TC/E-BCR/10 (TOA(G)/Kol dated 22-05-2002 submitted his option for fixation of his pay under FR 22.1(a)(i) in the promotional post with effect from 01-12-1998 i.e. the date of his next increment to the Assistant General Manager (Admn.), o/o The Chief General Manager, Eastern Telecom Region, Kolkata who did not even feel it necessary to award the fixation benefit in favour of the official within the frame work of rules. As a result the gentle man had to suffer financial loss to a great extent including drawl of less pay than his junior.
Subsequently the pay of Sri Prokash Kumar Basu, Chief Section Supervisor was stepped up to the stage of his junior Smt. Kalpana Mukherjee with effect from 01-01-2001 vide Eastern Telecom Region, Kolkata Memo No. ETR – CA-Admn. – 324/148 dated 13-12-2002. Accordingly his pensionery benefits were finalized.
It is noticed with utter dismay that based on the irrational interpretation of the BSNL Corporate Office letter No. 250-8/2003-Pers – III(Pt-1) dated 22-12-2004 the Eastern Telecom Region, Kolkata Memo No. ETR – CA-Admn. – 324/148 dated 13-12-2002 containing the order of stepping up of pay in respect of Sri Prokash Kumar Basu has been revoked vide No ETR/CA-Admn. – 324/158 dated 27-01-2005 which is not in conformity with the approach and principles of Rule FR 22 granting stepping up of pay. It is also surprising to note that instructions have already been issued for huge recovery of about Rs. 44000/- from the pension of Sri Basu without considering the fatal consequences of such orders.
In the above background it is urged upon you kindly to consider the case sympathetically in the light of the principles of the rules under F.R. covering stepping up of pay as well as to accept his option in respect of fixation of his pay with effect from the date of his increment i.e. 01-12-1998 on his promotion to BCR grade IV on 01-07-1998. It is also requested to ensure that pending final settlement of the case no recovery whatsoever should be made from the pensioner.
