Demand for rescinding the order withdrawing the system of payment of wages to the listed Casual Labourers through Labour Payment Bill. |
Sir,
This has a kind reference to this union letter of even no. dated 20-02-2006 intimating you about our resentment which has led to the Day-Long Dharna being staged today i.e. 21-02-2006 against your unprecedented and unilateral decision withdrawing the order No. Rectt./TS/X-65/Ch.VI dated 14-01-2004 determining the mode of payment for wage to the listed Casual Labourers through Labour Payment Bill. In this connection kindly refer to the Circle Council meeting held on 15-12-2005 where you had reported about your sincere endeavour for settlement of the issue of regularization of Casual Labourers within the current financial year. You may also recall our discussion on 06-02-2006 while meeting you to hand-over a letter regarding regularization of enlisted Casual Mazdoors including those of Krishnanagar Telecom District along with a copy of our letter addressed to our Chairman-cum-Managing Director, B.S.N.L. You assured us to talk to the CMD personally to settle the issue of proposed cancellation of the Krishnanagar list. Naturally, relying on your assurances we were hopeful about the settlement of the regularization issue.
It is therefore very much shocking and surprising to record that your arbitrary decision withdrawing the system of payment to the listed Casual Labourers through Labour Payment Bill is not only fueling to generate an unrest situation amongst the entire work force of the Circle but also significantly encouraging a breach of trust. We have therefore no alternative but to stand by the struggling Casual Labourers and demand for rescinding your order withdrawing the system of wage payment through Labour Payment Bill.

There is no denying of the fact that these Casual Labourers are rendering their sincere service for BSNL no less than our regular Group-D colleagues; They have been always for years together since their engagement in the Department as Casual Labourers making honest efforts to set up an effective and efficient Telecom Network in the entire West Bengal Circle. You have already recognized the services of such 2270 Casual Labourers as envisaged in recommending their names to BSNL H.Q. for absorption as regular employees. Accordingly the order determining the mode of payment to listed Casual Labourers through Labour Payment Bill was issued by you as back as the year 2003-04. After continuing the entire process for a period of more than two years it has been established that these Casual Labourers are inseparable from BSNL family and it can’t be even dreamt to run the BSNL services without their assistance and active co-operation which also necessitated you to recommend their names for regularization. You are now arbitrarily withdrawing the system of payment through Labour Payment Bill which has been determined by your own Administration causing serious uncertainty in their future prospect of regularization. It is therefore, not in conformity with the principles of an ideal industry’s relation with the recognized Trade Union. Your arbitrary action, as it appears, is a step towards denial of justice.
Consequent upon the above logic you will surely, it is believed, reconsider your decision rescinding your order withdrawing the system of payment of wage to the listed Casual Labourers through Labour Payment Bill and not compel us to take recourse to higher form of Trade Union action including non-cooperation from the date of effect of the retrograde order.
